What the law requires us to say

1. Preamble

This legal notice applies to the entire website accessible at the address quintessenceprovence.fr (hereinafter “the Site”), as well as to the weekly letter associated with it. Consulting the Site constitutes full and complete acceptance of the present terms. They may be amended at any time; the applicable version is the one online on the day of consultation. The user is invited to consult them regularly.

2. Definitions

“Site” refers to all the pages accessible under the domain name quintessenceprovence.fr. “Publisher” refers to the legal entity identified in article 6 of the present terms. “User” refers to any person who accesses the Site. “Keeper” (gardien) refers to the user who holds an account, admitted into the circle of readers of the letter. “Contents” refers to the texts, photographs, maps, graphic and audio elements published on the Site.

3. Access to the Site

The Site is freely accessible to any user with an internet connection. Connection and equipment costs remain the user’s responsibility. The Publisher applies reasonable means to ensure continuous access to the Site, without being bound by an obligation of result: access may be suspended, limited or interrupted at any time, notably for reasons of maintenance, updating or for any other technical reason, without the Publisher’s liability being incurred. Certain sections of the Site (the Map, the entries for the places, the keepers’ space) are reserved for account holders.

4. Intellectual property

All the Contents of the Site — the texts of the letters, the accounts and descriptions of the places, the written directions, the photographs, the maps, the visual identity, the seal — are protected by the provisions of the French Intellectual Property Code. Any reproduction, representation, distribution, extraction or reuse, in whole or in part, of the Contents, by any means whatsoever, without prior written authorisation, is prohibited and constitutes an infringement punishable under articles L.335-2 and following of the Intellectual Property Code. This prohibition covers in particular the reuse of the descriptions of places and of the itineraries, including in reworded form, for commercial or editorial purposes. The locations entrusted to the keepers are so entrusted on a strictly personal basis.

5. Liability

The information published on the Site is given for guidance only and without warranty of accuracy, completeness or currency; it may in particular change with the seasons, with municipal orders and with the state of the paths. Visiting the places described is done under the sole responsibility of the user, who remains the only judge of their capacities, their equipment and the conditions of the day. The Publisher recalls that certain places demand caution (unsupervised swimming, steep paths, mistral) and invites everyone to read the recommendations specific to each place before setting out. Any hypertext links present towards third-party sites do not commit the Publisher as to their content.

6. Identification of the publisher and the host

The Site is published by ELON, a simplified joint-stock company with a sole shareholder, with a capital of 500 euros, whose registered office is Allée des Amandiers, 13114 Puyloubier, registered in the Trade and Companies Register of Aix-en-Provence under number 931 699 607. The director of publication is the president of the company, Nicolas Hullmann. The Publisher may be reached by electronic mail at the address lettre@quintessenceprovence.fr, which constitutes the primary means of contact for any question relating to the Site.

The Site is hosted by Hostinger International Ltd, 61 Lordou Vironos Street, 6023 Larnaca, Cyprus.

7. Personal data

The house engages in no resale of data, no third-party advertising, no behavioural analytics. It keeps only what you entrust to it: your candidacy presentation, your keeper’s account (email, first name, portrait if you fill it in), your words in the margin, your marked visits. This data serves solely to keep the letter and the Map alive — never sold, never shared. Consent to being put in touch (keeper’s portrait) is optional, timestamped, and revocable with a single word.

Your rights: access, rectification, erasure, objection and portability — an email to lettre@quintessenceprovence.fr suffices, and the reply comes from a person, not a robot. You may also refer the matter to the CNIL (cnil.fr). Leaving the house erases your account and your data upon simple request. Data is kept for the lifetime of the account, then deleted; candidacies not admitted are kept for twelve months at most.

8. Cookies and audience measurement

The Site places cookies strictly necessary for its functioning: qp_porte (the key of the season, 90 days) · qp_entre (entry comfort, 90 days) · WordPress connection cookies (your keeper’s account, session) · qp_langue (your language, 1 year) · qp_feuillets (the rhythm of the places, 40 days) · qp_src (the origin of your first visit, 90 days) · qp_info_cookies (hides the note about cookies, 13 months).

Two further placements are made only with your agreement, given in the note about cookies: qp_fonds (the display of the map backgrounds, 1 year — to withdraw here: withdraw my agreement) and qp_pixel (your choice regarding Meta audience measurement, 6 months). Meta audience measurement — the “pixel” — is never activated without your explicit agreement; until you have said yes, no signal departs and no tracker is placed. You may withdraw this agreement at any time here: withdraw my agreement.

9. Sub-processors

Within the meaning of the GDPR, the Publisher engages the following sub-processors: Hostinger (hosting of the site, sending of emails and of the Thursday letter) · Anthropic (writing and translation of editorial content — no visitor data is transmitted to it) · OpenStreetMap (map backgrounds: your IP address reaches its servers if you choose to display the Map) · Meta (audience measurement by pixel, only if you have accepted it in the note about cookies).

10. Applicable law

The present terms are subject to French law. As the service is provided free of charge, any dispute relating to its use shall fall, failing an amicable resolution — which will always be sought first through a simple exchange of electronic mail —, within the competent jurisdictions under the conditions of ordinary law.
